California goes after Delta Airlines for not complying with privacy law

By: (more) | Business, Financial & Legal News | Posted: Dec 7, 2012 2:45 am

Remember that warning we issued about app developers needing to have a privacy policy if they didn't want to face fines of $2,500 per download? Well, Delta Airlines apparently decided that they didn't need to abide by that law and are now front and center as CA Attorney General Kamala D. Harris has filed a lawsuit against the company.

"Losing your personal privacy should not be the cost of using mobile apps, but all too often it is," said Attorney General Harris. "California law is clear that mobile apps collecting personal information need privacy policies, and that the users of those apps deserve to know what is being done with their personal information."

Harris claims that Delta has operated a mobile app, known as "Fly Detla," since 2010 and that the app collects private data and does not feature a privacy policy. She is seeking an injunction against the distribution of the app and penalties of up to $2,500 for each violation. The full press release is available on the CA.gov website.
